ACM Italian Holiday Terms & Conditions

 

  1. Booking and Payment

1.1 A booking is confirmed only upon receipt of the required deposit.

1.2 Pricing:

Shared King Room (2 guests): $7,250 total ($3,625 per person)
Single Occupancy King Room: $5,299 per person

1.3 Deposits:

Single room: $1,000 per person (non-refundable)
Shared room: $1,000 per person (non-refundable)

1.4 The remaining balance must be paid within 30 days of booking unless otherwise agreed in writing.

1.5 Failure to pay the balance by the due date may result in cancellation of the booking and forfeiture of the deposit.

  1. Cancellation by Guest

2.1 Due to upfront retreat costs, supplier commitments, and limited availability, payments are non-refundable once made, except where required by law.

2.2 All deposits are strictly non-refundable.

2.3 If a guest cancels after full payment has been made, no refunds will be provided.

2.4 Bookings may be transferred to another person at the organiser’s discretion.

  1. Cancellation by Organiser

3.1 If the organiser cancels the retreat for any reason, guests may choose either:

A full refund including deposit, or
Transfer to a future retreat.

3.2 If no future retreat is scheduled, a full refund will be issued.

3.3 The organiser is not responsible for any external costs incurred by guests, including flights or travel arrangements.

  1. Inclusions

The retreat includes:

Return van transfers from a designated Rome meeting location
Six nights accommodation
Daily breakfast, lunch, and dinner
Drinks during hosted meals
Pizza making experience
Pasta making experience
Day spa experience including restaurant lunch
Yoga classes

  1. Exclusions

The retreat price does not include:

Flights
Travel insurance
Personal expenses
Any items not expressly listed as included

  1. Travel Insurance Requirement

6.1 All guests must hold comprehensive travel insurance covering medical expenses, trip cancellation, personal injury, and travel disruption.

6.2 Proof of insurance may be requested prior to departure.

  1. Health and Participation

7.1 Guests are responsible for ensuring they are medically and physically fit to participate in yoga activities.

7.2 Participation in all activities is undertaken at the guest’s own risk.

  1. Force Majeure

8.1 The organiser shall not be liable for failure to deliver the retreat due to circumstances beyond reasonable control, including natural disasters, pandemics, government restrictions, war, civil unrest, strikes, or transportation disruptions.

8.2 In such circumstances, the organiser may reschedule the retreat, offer transfer to a future retreat, or provide a refund at their discretion, less any unrecoverable costs.

  1. Liability

9.1 To the extent permitted by law, the organiser is not liable for personal injury, loss, or damage to property, or travel delays and disruptions.

9.2 Nothing in these terms excludes rights under Australian Consumer Law.

  1. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia, and any disputes shall be subject to the jurisdiction of courts located in Melbourne.

  1. Waiver and Assumption of Risk Requirement

11.1 Participation in the retreat and all activities is conditional upon each guest signing a Waiver and Assumption of Risk Agreement provided by the organiser.

11.2 Guests who do not sign the waiver prior to the retreat commencement will not be permitted to participate in any activities and will not be entitled to any refund.

11.3 The waiver forms part of these Terms and Conditions.

  1. Minimum Participant Numbers

12.1 The retreat requires a minimum number of participants to proceed.

12.2 If the minimum number is not reached, the organiser reserves the right to cancel the retreat.

12.3 In such circumstances, guests will be offered a full refund including deposit or transfer to a future retreat.

12.4 The organiser is not responsible for any external costs incurred by guests, including flights.

  1. Shared Room Bookings

13.1 Guests booking a shared room are responsible for ensuring their travel companion attends.

13.2 If one guest in a shared booking cancels, the remaining guest must either pay the single occupancy rate or provide a replacement participant approved by the organiser.

13.3 No refunds will be provided due to roommate cancellation.

  1. Behaviour and Conduct

14.1 The organiser reserves the right to remove any guest from the retreat without refund if their behaviour is deemed disruptive, unsafe, illegal, or harassing.

14.2 This includes excessive intoxication, aggressive conduct, or failure to follow reasonable instructions.

  1. Alcohol Consumption

15.1 Alcohol may be provided during hosted meals.

15.2 Guests are responsible for their own consumption and behaviour.

15.3 The organiser accepts no liability for incidents resulting from alcohol consumption.

  1. Payment Plans

16.1 Payment plans may be offered at the organiser’s discretion.

16.2 Failure to meet payment deadlines may result in cancellation of the booking and forfeiture of payments made.

  1. Changes to Itinerary

17.1 The organiser reserves the right to make reasonable changes to accommodation, activities, instructors, or schedule where necessary due to circumstances beyond control.

17.2 Any changes will be of a comparable standard.

  1. Third-Party Providers

18.1 Certain services are provided by third parties.

18.2 The organiser is not liable for the acts, omissions, or failures of third-party providers.

  1. Travel Documentation Responsibility

19.1 Guests are solely responsible for valid passports, visas, entry requirements, and vaccination requirements.

19.2 No refunds will be provided due to failure to meet travel requirements.
